Bargaining with Imperfect Enforcement

چکیده
Bargaining with Imperfect Enforcement* The game-theoretic bargaining literature insists on non-cooperative bargaining procedure but allows 'cooperative' implementation of agreements. The effect of this is to allow free-reign of bargaining power with no check upon it. In reality, courts cannot implement agreements costlessly, and parties often prefer to use 'non-cooperative' implementation. We present a bargaining model which incorporates the idea that agreements may be enforced noncooperatively. We show that this has a substantial impact in limiting the inequality of agreements, and results in a non-montonicity of the discount rate. The general need to maintain incentives for co-operation means it may appear that 'other-regarding' elements enter agents' utility functions. This helps us to understand why experimental subjects might begin negotiations anticipating 'fair' bargains. The model also explains why some parties may have incentives to deliberately write incomplete contracts which cannot be enforced in a court of law. JEL Classification: C72, C78, C91 and D23

Trade and Contract Enforcement
We develop a simple model of trade with imperfect contract enforcement. Courts force the execution of defaulted contracts with parametric probability. In political economic equilibrium, the enforcement of contracts between agents of sovereign nations must be at a level mutually agreed between nations. The enforcement probability may be low, with the reluctant nation being associated with low le...

We address the problem faced by innovators who have an idea for a marketable product but must hire employees to bring the product to the market. Information leakage implies that newly hired employees become informed of the idea and may attempt to bring the product to the market themselves. We develop a bargaining model to analyze this situation. In this model, employees rents endogenously reße...
متن کاملTurning a Blind Eye: Costly Enforcement, Credible Commitment and Minimum
In many countries, noncompliance with minimum wage legislation is widespread, and authorities may be seen as having turned a blind eye to a legislation they have themselves passed. We show that turning a blind eye can indeed be an equilibrium phenomenon with ex post credibility, in a model of minimum wage policy with imperfect competition, imperfect enforcement and imperfect commitment. Since c...
متن کاملCheap talk in bargaining experiments: lying and threats in ultimatum games
In most models of bargaining, costless and unverifiable lies about private information and incredible threats about future actions are considered cheap talk and do not impact outcomes. In practice, however, this type of talk is often an integral part of bargaining. This experiment examines the impact of cheap talk in an ultimatum bargaining setting with two-sided imperfect information. In contr...

Does International Outsourcing Really Lower Workers’ Income? We analyze the impact of international outsourcing on income, if the domestic labor market is imperfect. We distinguish in our analysis between the case where the parties negotiate over the wage only and where they negotiate over both wage and profit share. We find that in the first case outsourcing will reduce (increase) workers’ inc...
